Searches of computers challenge general historical thoughts about searches and seizures. In one sense, a computer can be seen as a physical container or even a safe. In another sense, it is like a virtual locked diary. Given probable cause, law enforcement can obtain keys to homes or safes, and have file cabinets unlocked. But data protected by encryption or a passcode is also different from a container. What should the law look like to both protect individual civil liberties and national security?

Using the Hunt Library, find an example from the popular press wherein the government sought to collect digital electronic data giving rise to Fourth Amendment concerns.
Did/would the data collection equate to a search under the Fourth Amendment?
What factors should be taken into account in determining if a warrant is/should be required? Be specific in your response.
What facts and/or law support your position?
